1. Acceptance of Terms
By accessing or using Trustfy ("the Service"), you agree to be bound by these Terms of Service. Trustfy is a non-custodial peer-to-peer marketplace that facilitates the trading of USDT for local fiat currencies via smart-contract escrow on BNB Smart Chain. If you do not agree to these Terms, you may not access or use the Service.
2. Non-Custodial Nature
Trustfy is non-custodial by design. We never hold your USDT, your fiat currency, or your private keys. All escrow is enforced exclusively by the TrustfyEscrowV2 smart contract deployed on BNB Smart Chain. You are solely responsible for the security of your wallet, private keys, and recovery phrases. Trustfy cannot recover lost keys, reverse transactions, or access funds locked in smart contracts.
3. Eligibility
You must be at least 18 years old and legally permitted to trade cryptocurrency in your jurisdiction. Trustfy operates on BNB Smart Chain and supports users in 50+ economies across Africa, the Middle East, Asia-Pacific, the Americas, and Europe. You are responsible for complying with all applicable laws in your jurisdiction, including know-your-customer (KYC) requirements, anti-money-laundering (AML) regulations, and tax reporting obligations.
4. Trade Conduct
To maintain a safe and fair marketplace, all users must adhere to the following rules:
- Never send fiat before escrow is funded. Payment instructions are only shown after the seller's USDT is confirmed locked on-chain.
- Sellers must fund escrow within the 5-minute match funding window. Failure to do so results in an ad-bond slash.
- Both parties must maintain sufficient dispute bond capacity. Bonds are reserved when a trade is created.
- Bank references must never contain "USDT", "Crypto", or "Ethereum". Use your trade ID or a neutral note like "Services" to avoid bank flags.
- Third-party payments are strictly prohibited. The payment account name must match your verified identity.
- All communication must stay on-platform. If anyone asks you to trade outside Trustfy, report them immediately.
5. Fees
The platform fee is 0.5% per advertisement, paid by the ad maker (the person listing the offer). Takers pay zero platform fees. Gas fees for on-chain transactions (escrow locking, release) are paid by the seller. 20% of all escrow transaction fees fund the trade insurance pool, which provides up to 100 USDT per incident with 3-arbitrator approval required for payout.
6. Dispute Resolution
Disputes are resolved by independent, community-voted arbitrators — not by Trustfy staff. Both parties must submit evidence (bank receipts, screenshots, chat logs) within the 24-hour evidence window. The arbitrator reviews the evidence and issues a ruling that distributes the escrow per their judgment (amount-based, not winner-take-all). The losing party forfeits their dispute bond; arbitrator compensation is paid from the forfeiture, never from the escrow principal. Rulings are final and recorded on-chain.
7. Limitation of Liability
To the maximum extent permitted by law, Trustfy, its operators, and its contributors shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of fiat sent off-platform in violation of these Terms, loss of access to private keys, or damages resulting from smart-contract vulnerabilities. Trustfy provides the Service "as is" without warranties of any kind.
8. Smart Contract Finality
On-chain outcomes are final and immutable. The TrustfyEscrowV2 smart contract is the source of truth for all financial state, including escrow balances, trade statuses, and dispute resolutions. Backend database projections may lag behind the blockchain but never override contract truth. Users are encouraged to verify trade status on BscScan.
9. Prohibited Activities
You may not use the Service to: (a) launder money or finance terrorism; (b) trade with sanctioned individuals or jurisdictions; (c) use third-party bank accounts for payments; (d) manipulate prices or create false volume; (e) harass or defraud other users; (f) attempt to exploit smart-contract vulnerabilities. Violations result in immediate account suspension and forfeiture of bonds.
10. Modifications
We may modify these Terms with 7 days' notice posted on the Service. Continued use after the effective date constitutes acceptance of the modified Terms. Material changes will be communicated via in-app notification and, where applicable, Telegram broadcast.
